Terms and Conditions
Part A: Background
Brookwater Residential is proud to be a corporate sponsor of the Property Council Corporate Golf Day (01.06.23). As part of our sponsorship, we are delighted to have a stand located at hole three (3). As each golf participant arrives at hole three (3) they will have the opportunity to scan a QR code and enter their details to go into the draw for their chance to win a five-hundred-dollar ($500) gourmet gift basket. It is free to enter. The winner will win one (1)x $500 gourmet gift basket. The winner does not have to be present at the draw to win. The competition opens at 7.00am on 01.06.23. Entries close at 3.00pm on 01.06.23. The winner will be drawn at approx 3.00pm on 01.06.23. The winner will be announced at the Property Council Corporate Golf Day BBQ party at the Brookwater Golf & Country Club at on 01.06.23 and on the Brookwater Golf & Country Club Facebook page. This winning announcement may also be shared to the Brookwater Residential Facebook page.
Part B: Terms & Conditions
- Competition Open and Closing dates
1.1 The Competition opens at 7.00am on 1st June 2023 and Entries may be submitted from that date as set out in these terms and conditions.
1.2 The Competition closes at 3.00pm on 1st June 2023 and any Entries received after 3.00pm on that date will not be deemed valid Entries.
- Eligibility
2.1 Entrants must be natural persons aged 18 years or older and a golf participant of the Property Council Corporate Gold Day as at 01.06.23.
2.2 Any application to enter the Competition may be deemed to be invalid by the Organiser.
2.3 The Organiser may disqualify any Entrant at the Organiser’s discretion.
- How to enter the Competition
3.1 Entries must be submitted online through the online competition portal via the QR code displayed on the Brookwater Gold & Country Club sponsorship table at hole three (3).
3.2 The Entry must be fully completed, and the terms and conditions of the competition agreed to on the form for the Entry to be valid. Without limitation, the Entrant’s name, phone number and email will be required. The Entrant must also agree to be bound by these terms and conditions as part of the Entry.
3.3 Only one Entry per Entrant is permitted. Where Entrants submit more than one entry, the Judge may (in its absolute discretion) disqualify all Entries.
3.4 The Organiser will announce the Winner on the Organiser’s Facebook and/or similar social media page.
3.5 Upon submitting an Entry the Entrant is deemed to have agreed to these terms and conditions and provided their consent under the Privacy Act 1988 for the Organiser to use the Entry (including the Photo or Footage and Entrant’s personal details) as set out in these terms and conditions and as set out in the Organiser’s privacy policy located here: https://www.greaterspringfield.com.au/privacy/.
- Judging
4.1 The Winner of the Competition will be determined by the Judge in the Judge’s absolute discretion.
4.2 The Judge’s decision on any matter relating to this Competition will be final and cannot be appealed.
4.3 The Winner, if not present at the Property Council BBQ Party held at the Brookwater Golf & Country Club at 3.00pm on 01.06.23 will be contacted by phone no later than 2 business days from the close of the Competition.
4.4 Entrants that are not Winners will not be contacted by the Organiser.
4.5 There may be more than one Winner (at the discretion of the Judge).
4.6 Criteria for selecting the Winner will include:- (a) All entries will be placed in a barrel.
- (b) One (1) entry will be drawn by a representative of Brookwater Golf &Country Club.
- (c) any other criteria the Judge decides in the Judge’s absolute discretion.
- The Prize
5.1 The Winner will receive:
(a) One (1) five-hundred-dollar ($500)gourmet gift basket.
5.2 The gourmet gift basket will be provided to the winner within two (2) business days of the Winner being chosen provided all of the terms and conditions of the Competition have been complied with by the Winner.
5.3 The judges may select another Winner if the Winner does not comply with the terms and condition of the Competition.
5.4 The prize can not be redeemed for cash and can not to changed.
- Intellectual Property
6.1 The Entrant agrees that the Photo or Footage may be used by the Organiser or the Judges for any purpose associated with the Organiser’s business. Without limitation, the Entrant consents to the Organiser using the Photo or Footage in any of the Organiser’s marketing materials, books, videos, promotional materials.
6.2 The Entrant also agrees that the Organiser may use the Photo or Footage in its original form or that the Organiser may alter the Photo in any manner as the Organiser deems appropriate.
- Liability
7.1 Nothing in these general terms restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
7.2 Subject to claus, the Organiser or any Judge is not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death arising out of or in connection with the Competition or the use of any Photo by the Organiser.
- Privacy
8.1 Upon submitting an Entry, the Entrant consents to the Photo and Entry being re-published and used by the Organiser in any form for any purpose associated with the Organiser’s business. This includes the re-publishing or use of the Photo, any caption and the Entrant’s name.
8.2 The Entrant further agrees to be added to the Organiser’s marketing database and consents to the use of the Entrant’s submitted information in accordance with the Organiser’s privacy policy set out here: https://www.greaterspringfield.com.au/privacy/.
- General
9.1 The laws of Queensland apply to this competition.
- Definitions
10.1 In these terms and conditions, the following words have these meanings unless the contrary interpretation appears:
(a) Entrant means a person that enters theCompetition and who is eligible to enter pursuant to these terms.
(b) Entry or Entries means an application from an Entrant in accordance with these terms and conditions to be considered to win the Competition.
(c) Claims means any claim, damage, cost, expense, action, demand or similar against the Organiser.
(d) Competition means the Brookwater Golf& Country Club Property CouncilCorporate Gold Day $500 Gourmet GiftBasket competition described in Part A on the terms and conditions set out in these terms.
(e) Intellectual Property means all intellectual property, moral rights, copyright and similar rights in the Photo and any part of the Entry
(f) Judges means Vanessa Williams and any other person that Vanessa Williams nominates as a judge.
(g) Organiser means Springfield City GroupPty Ltd and where the context permits includes any related and associated entities of Springfield City Group Pty Ltd.
(h) Photo or Footage means the photographs, videos, footage or images taken of the Entrant by the Organiser.
(i) Winner means the person the Judges judge as the winner of the Competition asset out in these terms and conditions.
